(“You”, “Your”, “Customer” , “Client”, “Users” all refering or are in relation to You the Client availing My-Will Services) whereas (“Us”, “Our”, “My-Will” “We” and or “Company” Refers to My-Will and shall include its associates, employees and team members directly engaged in offering business services to You .

My-Will Services includes but is not limited to Will Writing, Custody Services, Execution, Succession and Estate Planning, Consultation advice, assistance in preparing customised Wills and other allied document(s) or documentation pertaining to Will writing, Will Custody, succession and estate planning as per Indian Law, in execution, attestation, storage, custody, translation, registration, notarization of Wills as per practice / preference, which may include producing the same in India as per Indian laws, all of which shall be collectively or in part referred to as “Services”)

This Page provides the Terms of Use (“ToU Document” or “ToU”) under which Users / Customers may use the www.my-will.in (“Website”), a portal and unit of M/s Avon Global Solutions Private Limited a Company duly incorporated under the Indian Companies Act, 1956.

This ToU Document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usages of Website.

We provide general information about prevailing laws and regulations relating to personal succession, Wills and Estate planning in India or assets based in India and on various issue relating to personal laws in India and also news, latest updates, judgments, cases and other allied information pertaining thereto to the best of our knowledge and information available in public domain. We are not a law firm or member of Bar Council of India; however, we have employed qualified and experienced lawyers being member of Bar Council of India. Our services are based on Legal Process Outsourcing model to provide you services at your desktop computer or mobile through a team of lawyers of My-Will We provide automated on-line software/application which would enable you to write contents of your Will, effectively plan your succession and bequeath plans, opt for safe Custody of Your Will and other Services as defined above, all as per the Indian Laws and we also provide other offline customized services. We provide advice & assistance in preparing and/or verifying Will and other allied documents pertaining to succession and estate planning as per Indian Laws. We also provide guidance and assistance in execution, attestation, storage, custody, translation, registration of Will as per practice and produce in India as per Indian Laws. We can recommend advocates, service providers and such other person for assistance and guidance for registration and notarization of Will at certain locations in India as listed on the website. We also undertake and / or facilitate and /or recommend person / corporate bodies who can undertake custodian and executor services pertaining to Wills as per Indian Laws. The information, assistance and documentation provided is only to guide you in creation of Will, Settlement and Succession related or allied Legal and General Non-Legal Documents but does not constitute legal, financial or tax advice.

My-Will shall bear no liability both direct and indirect for negligence on the Clients part while availing of any of Our Services.

The media or services on the Website may be out of date, and My-Will makes no commitment to update these materials on the website, neither does My-Will take any responsibility towards any direct or indirect liabilities, damages or claims made by any users, third parties or persons acting on such media or information or content or language, made available on the Website

5. Eligibility To Use The Website

By using the Website, you represent and warrant that (1) all information you submit, provide in oral or written form to us is truthful, current, complete, lawful and accurate; (2) your use of the Website does not violate any applicable law or regulation; and (3) you are at least 18 years of age or have received parental consent and supervision when using the website www.my-will.in. My-Will may, at its sole and absolute discretion and at any time, terminate your privilege to use this Website for any other reason.

6. On-line Services

i. We require all clients who wish to make Will online need to sign up and or Register with their account / details by completing all required fields on the respective registration web pages on the Website

ii. As part of the registration process, you agree that you are above 18 years of age and you have read all policies of this website. You also agree to provide: (a) information about yourself that is truthful, current, complete and accurate; and (b) update this information so as to maintain its accuracy.

iii. On your providing registration details an email will be sent to you by the Company at your registered Email ID to take you through the next steps.

iv. In case of Clients availing MIY Will writing service, post Registration you will receive in addition to our Welcome Email a permalink for your access or information about your log-in and password details.

v. In case of permalink it is your responsibility to ensure that no one else has access to the e-mail ID containing your permalink to access your Payment Access and Will Planning Form and for the future use of any of the Company’s Services.

vi. In Case of Account Creation you will have to use log-in and password details to make Payment (online or offline) and for the use of Company’ s MIY Will Writing application.

vii. On successful receipt of payment from your side the Company will allow you to have access to the Service opted by You, after payment is made you have 60 days to fill in details to create Will your Will.

viii. We reserve the right to terminate or not offer service to accounts or users who misappropriate the name, e-mail address, or other personally identifiable information of another individual or provide incomplete or improper personal details like e-mail address, name, number or other personal identifiable information.

ix. We also reserve the right to refuse to approve a user account or provide our service to a user or terminate an existing user account or service to a user with or without cause or notice (other than any notice required by applicable law and not waived herein) for any reason at any time.

x. We are not liable for any losses or damages incurred by you as a result of the termination of your account or refusal of our services to you. We reserve our rights and have sole discretion in all such instances where we decide not to provide our service to a particular individual or user

xi. Our digital and online services consist of a Make-it–Yourself Will (MIY Will), which is an online digital service offered via online tools and or software/application which is best suitable for simple and common man’s easy requirements focused on accessibility and ease of use. Our Services requires your personal details including religion (as per Succession laws) and other specifications so that a legal Will and Will related services can be drafted online for you as per the Indian Laws. MIY Will Services offers an easy to use online solution to individuals who choose to prepare their own Will vide use of our Service.

xii. A Customer need not download or require any license for using any of the My-Will Service or for successfully using and operating the My-Will Service. Our Service is hosted on My-Will website server which is fully owned by the Company and on making payment via individually generated payment link a Customer will have limited and/or reserved rights to access the MIY Will software as hosted at www.my-will.in for one Will only as per payment and log-in

xiii. On registration each customer would be provided access with their personal email id used for registration to access the MIY Will Planning Forms and other allied planning documents, the personal email ID of the Customer used to Register will serve and act as the unique ID for the Customer (“Customer Login” or “Login”) for ease of access to service, which would enable Client to commence MIY Will Planning Form / application / software once payment is received by the Company. The Company will allow customer to access MIY Will Planning Forms for fillingin details to produce one MIY Will using the Customers login.

iv. The Login access is unique and only for the personal use of the Client for the purpose of creation of one Will for a customer and it is nontransferable and non-assignable. The customer shall be solely liable in case of any misuse of their personal login credentials and password. The Customer is required to forthwith intimate us in case of any misuse of their login or any unauthorized access to MIY Will and in such a case we shall take the necessary steps to remedy the same including blocking the Customer Login for some time or changing the same.

xv. You are solely responsible for maintaining the confidentiality of your personal login credential and password. You shall not share your account with anyone else. You agree not to share your account, username or password of anyone else in which case My-Will, shall not be held liable for any form of misappropriation or misuse of information. Customer shall not disclose password to anyone other party. You agree to have only one account. You agree to take all reasonable precautions to prevent others from using your account. You agree to notify us immediately of any unauthorized use of your personal account.

xvi. A MIY Will Process provides a customer to prepare Will using multiple options and categories available on the website and the customer is required to choose options and category which is applicable to him/her.

xvii. You may contact us and /or seek our legal advice in case you are not sure which option/s and categories to select and /or are unsure about the process, working and applicability of MIY Will.

xviii. We have tried to ensure that all general circumstances, events are covered in respect to each category of MIY Will and that necessary options are provided in such category to cover all such general eventualities. However, a MIY Will may not cover all individual circumstances and special circumstances, in which case Consultation service would be appropriate to give you the right kind of framework suited best to your individual needs.

xix. Any MIY Will produced by this website and executed without first obtaining legal advice or doing your own legal research is done so entirely at your own risk, and you accept full responsibility should it prove to be unsuitable to your circumstances. A specialist legal advice should always be sought in relation to any particular circumstances.

xx. We have tried to ensure that all general circumstances, events are covered in respect to each category of MIY Will and that necessary options are provided in such category to cover all such general eventualities. However a MIY Will may not cover all individual circumstances and special circumstances.

xxi. You are required to contact us or seek our legal advice in case a MIY Will Draft provided by My-Will does not cover a part or any of your individual or special circumstances.

xxii. A MIY Will would require you to fill in all the requisite details as per the format and in the manner provided for in the template/software/app. Any information which is not in accordance to the prescribed format would require re-work and clarification from your end.

xxiii. While certain details and clauses are mandatory, the other details and clauses may not be. You may also be provided with an option to provide alternatives towards a particular clause while not providing the complete detail in respect thereto.

xxiv. It is understood by you that, You as a Customer is advised based on the service opted by you from My-Will and based on individual circumstances so specified by You. All Drafts are sent for Approval to the Customer. My-Will shall proceed further with the next steps only after the Customer has approved such draft as the Final.

xxv. You need to ascertain and confirm that you do not intend to select the requisite optional clauses and /or details, if provided for in the MIY Will Planning Form. You may contact us or seek for legal advice in case you are unsure whether to select any particular optional clause and/or details and if the same is not applicable to you.

xxvi. You are required to save all the details as per the format provided on the website. You may amend, change or modify your Will Planning Form prior to submission for Drafting at any point of time within 60 days from the date of payment. However, you are required to complete the MIY Will Planning Form within 60 days (inclusive of holidays and non-working days) from the date of payment to generate the Will. “Generate” a MIY Will shall mean creation of draft of one MIY Will in read-only format, this is a security protocol to ensure that no information is changed or modified without consent.

xxvii. Once you make payment, My-Will will make all efforts to remind you regularly so that you can complete your Will draft before expiry of 60 days. However, it is IMPORTANT to note that In case you fail or neglect to Generate your Will draft within 60 days then your access would be disabled, without any further notice and the MIY Will Planning Form and any other details filled by you shall be erased from the system. My-Will will not be responsible to make refund or provide any of your details you have filled-in to make a Will. Your payment will be treated as lapse hence after expiry of 60 days when you have not completed Will, you will have to do fresh registration and also fresh payments. My-Will, shall not be held liable under any such circumstances or demands made after 60 days from payment.

xxviii. You are required to intimate us in case of any operational or system issues from our end only and we will fix the same within a reasonable period of time.

xxix. Once the Will planning Form is completed from your end, We will Generate Your Customised Draft within 5 Working Days from submission and the same will be sent to you in Preview only Format (prior to Will Generation) for Approval. You are required to read, verify the entire Will Draft and confirm contains thereof. You may suggest edits and or modifications as comments and the same will be included as per your requirement for language and intention. However for security reasons, you will not be able to modify or add or delete any clause, if there are changes or modifications to be made we will ensure to make the same based on your written instructions, however where you are unsure about changes, you may avail our telephonic consultation services.

xxx. A Will generated and printed on plain paper (no stamp paper needed) shall be legally viable document after signing and attesting by 2 witnesses as per the instructions on the Guidelines Document Provided to You.

7. Affiliates

a. We may team up with banks, financial institutions, insurance advisors or such other corporate bodies and individuals (Affiliates) to create awareness and market and sale of or whitelabel My-Will Services and other products

b. We shall display the names and types of services being offered through our affiliates on our website.

c. You may access this website by clicking a link provided on the websites of our affiliates. You are required to ensure that such link and access is being provided by our authorized affiliates. You are required to intimate us in case of unauthorized or illegal access being granted of offered to you. The link to this website would be provided as and by way of link to third party websites by our affiliates.

d. All the customers accessing this website and/or utilizing our services through our affiliates shall be subject to present terms of use and all the arrangements/agreements for use of our services shall be between us and such customers and our affiliate shall not be a party to the same.

e. We shall be our sole prerogative to determine whether to provide our services to any customer accessing our website through our affiliates. We are not obligated to provide any services contrary to prevailing laws, terms of use and in the event of refusal to accept and pay our charges in respect to same.

f. We may offer certain incentives and/or payments to our affiliates as and by way of consideration for creating awareness about our services and products and you here by consent for the same.

8. Off-Line Services/Other Services

a. In addition to our MIY Online Will Writing Service, which is completely customised, we also provide advice and assistance in preparing and verifying Wills and other allied documents pertaining to succession and estate planning as per Indian Laws.

b. We also provide guidance and assistance in execution, attestation, storage, custody, translation of Wills as per practice and produce in India and as per Indian Laws.

c. We can recommend advocates, consultants, clerks and such other person for assistance and guidance for registration and notarization of Will at certain locations in India as listed on the website.

d. We also undertake and /or recommend person/corporate bodies who can undertake custodian and executor services pertaining to Wills as per Indian Laws.

e. In order to avail any of these services you are required to contact us and/or intimate us in the manner set-out on the website and we shall reach out back to you with the requisite process and pricing.

9. Payments

i. You can make payment for our online services in the manner set-out on the website which may include via payment gateway or individual link generation, Google Pay or other approved modes of payment vetted by us and for offline services you can make payment by NEFT, Payment link or cheque.

ii. We shall be liable to charge and recover the charges in respect to payment gateway or links from you in the event you choose to make payment through payment gate way.

iii. All the services will attract service tax at the applicable rates.

10. Cancellation and Refund

o Refund cannot be claimed once the Will document is generated using our Online Will writing tools.

o In case of other services you may seek refund if our services do not suit your requirement or the delivery of services are delayed beyond 72 hrs or the same are not in accordance to normal industry standard and we are unable to remedy the issues of delay and quality within 96 hrs - refund will be processed within 3 to 5 working days.

a. It shall be our sole discretion to determine whether a particular case is appropriate for full refund or not

b. Any refunds made shall be subject to deduction of payment gateway charges by us, if applicable.

11. Confidentiality

a. We are committed to maintaining privacy and confidentiality of data and information and with a view thereof we have included special features in our online services.

b. The Will Planning Form is personal to your use and acts as the first tool towards efficiently drafting your customised Will. Access to the Will Planing Form is provided only to your registered email id. Any loss or misuse of information from your registered email id shall not be borne by the Company.

c. We assure absolute confidentiality of your data which are shared in the Will Writing process, we have embedded trackers to understand the changes made making it easy and efficient at the same time. Since website is secured and as per the technology which secure accessing of any data from any third person except the authorised user and your data, details are accessible to our team tracked and only on a need to know basis, we do not share data for any of our website related agencies for server, hosting, content database storing etc. Our Will Writing Service is provided as a means to offer easy and accessible solution to our customers, information provided by you at any point of time shall be at your sole discretion and you get to determine the type of access and amount of information to be provided to us in case of any operation, technical or process related issues or to seek our assistance or legal advice .You may choose not to grant any access to us and share any information with us in while seek our assistance for any operation, technical or process related issues and to seek our legal advice. In such an event we would be able to offer only limited help and assistance to resolve operation, technical or process related issues or legal problem faced by you. We will only have your registration details like name, email ID, city name, cell number (if any) and such details will only be used to communicate to you for your requirements for our services.

d. We would not be able to retrieve or produce a copy of a MIY Will once generated by the system after a 60 day period.

e. All the data and information entered by you in the MIY Will shall be retained by the system till such time as the Will is generated (maximum 60 days from payment date), whichever is earlier and on expiry thereof all the data ,information and copy of MIY Will shall be erased from of our system without any further notice

f. You are required to take necessary steps to save/print a MIY Will duly generated at your end, we shall not be liable in case of neglect or failure to save/print the same. In case if you are not sure of the process and system you may seek our assistance. Depending on the service opted by you, My-Will, will send you a copy of your Will to your place of convenience.

g. After the 60 day period, we shall not be able to access your MIY Will at any point of time. Our system does not retain any of your data, information or a copy of your MIY Will and we shall not be liable in case of any misuse, unauthorized access thereto.

h. We only retain your personal information provided by you at the time of your User Registration for internal reports, accounting, sending administrative e-mails, informing about any changes or additions to the website, intimating you about our latest offers and in the manner as setout in our privacy policy. We shall not share or disclose such information except in cases as mentioned in our privacy policy.

12. Legal Jurisdiction & Personal Laws

a. Our MIY Will process and other services are designed to be suitable for the application of the law of India and can are designed for Indian citizens and NRIs having assets / properties in India.

b. If individual having any assets outside India, it is advisable to create a separate Will in that country as per their local laws. However, if you generate MIY Will using our services for those foreign assets the possible legal issues arising in future will be entirely at your own risk.

c. As per the Muslim Personal Law as prevailing in India there are certain restrictions in respect to a person practicing and following Islam and succession to be as per Sharia or Sunni laws are applicable hence online MIY Will writing is recommended with consultation in such cases.

d. All communication that we send to you will assume that you have read this notice.

13. Law Changes

a. We strive to keep all our Wills generated accurate, current and up-to-date and we try to update the process from time to time by incorporating any changes in law therein.

b. However, because the law changes rapidly, we cannot guarantee that all of the information on the Website or Provided as part of the Service is completely current.

c. The law is different from jurisdiction to jurisdiction, and may be subject to interpretation by different courts.

d. The law is a personal matter, and no general information or legal tool including MIY Will can fit every circumstance.

e. Furthermore, the legal information contained on the Website and MIY Will Generation Process is not legal advice and is not guaranteed to be correct, complete or up-to-date. Therefore, if you need legal advice for your specific problem, please seek our legal advice or legal advice of your advocate in respect there to.

14. Articles and News

a. We may display information and articles about laws regulation pertaining to personal succession, Wills and estate planning in India.

b. It shall be our sole discretion to determine the type of information and articles to be displayed and the duration and manner of such display.

a. www.my-will.in grants you a limited, personal, non-exclusive, non-transferable license to use our Online Will Writing for your own personal use,

b. You acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit MIY Will or any of the My-Will Services in any manner, except for modifications in filling out the same for your authorized use.

c. By using or generating MIY Will you agree that your use or generation to be used only for you for your personal use and may not be sold or redistributed without our express written consent

18. Trademarks

The trademarks, service marks, information, content, text, sounds, images, graphics, logos, page headers, page footers, button icons, scripts, service names, including the trade name www.my-will.in, shall be the explicit trademark or trade dress of Such trademark or trade dresses shall not be used in the remotest connection with any product or service that does not belong to us, in any manner, which shall cause, or is likely to cause, any confusion among clients, experts, affiliates or any other third party, including the public. Such trademark or trade dress shall not be used in any manner that disparages us or discredits us. Any trademark appearing on the website that does not belong to our subsidiaries or us shall be the property of such respective owners who may or may not be affiliated with, connected to, or sponsored by us. Nothing in this Terms of Use shall be construed as conferring by implication, estoppels or otherwise, any license or right under any copyright, patent, trade mark, database right, sui generis right or other intellectual property or proprietary interest of Avon Global Solutions and or T R Vasanthakrishnan, its licensors or any third party.

My-Will and Avon Global Solutions Pvt. Ltd is the sole owner of all material and content of this Website as well as My-Will documents/ interface, which includes but is not limited to application / software. All such content is protected under intellectual property and proprietary rights laws. You may use the Website and its content and materials only for the purposes stated in this User Agreement. You may copy such content for your own personal, non-commercial use only, provided you do not alter it or remove any copyright, trademark or other proprietary notice.
